Civil Mediation

Civil claims arise out of disputes between two or more legal entities such as people, companies, governments etc. These claims usually follow certain steps, such as making a demand to pay money, fulfil a promise or rectify a broken agreement.

A civil case usually begins when one person or business (the "plaintiff") claims to have been harmed by the actions of another person or business (the "defendant") and asks the court for relief by filing a "complaint" and starting a court case.

While mediation is usually a voluntary process, the court orders the parties to mediation. During the process a neutral, independent mediator, assists the parties to resolve the dispute. These discussions are usually confidential and if an agreement is reached the parties may sign a written agreement or memorandum of understanding to confirm their terms of agreement.

Notice:

  • Mediation Payment, Overtime Fees, Cancellation and Rescheduling Terms apply to all Judicial Districts, unless identified. Mediation Payment amounts tend to vary per judicial District. 

  • Mediation Payment, Overtime Fees, Cancellation and Rescheduling Terms apply to all Judicial Districts, unless identified. ODR Mediation Rates for Civil County (C) cases are $50.00 per hour per party for a total of $100.00 for a 2 Hour Mediation.​

  • Indigent parties (IFP) with a State Approved Reduced Fee have a Rate of $15.00 per hour, per party for a total of $30.00 for a 2 Hour Mediation.​​ No-Show Indigent parties may invalidate the reduced rate and apply full mediation fees.

  • ​Payments are processed by Pay Pal and appear as BBMediation on your Bank and, or Credit Card Statements.

Payment Method

  • PayPal, Credit Card, Check or Money Order​, Attorney Representation. All payments need to include the Parties' Name, Case Number, and Mediation Date. 

  • BBM does not request, unless for clearly stated purposes, share, sell, nor disclose information unless required by law or statute. Click here for Information Privacy & BBM's Privacy Policy.

Payment Amount

  • Each party is required to pay for their own mediation fee $100.00 for the court mandated minimum two hour mediation session. 

Payment Due Date

  • Payments are due Ten (10) calendar days before the date scheduled for mediation.​ Failure to comply may cancel the mediation and impose a Late Cancelation Fee.

No - Show

  • Failure to appear to a scheduled mediation will cancel the mediation. A Full Mediation Cost Fee $200.00 will be imposed on the No-Show party.

​​Overtime

  • Additional mediation time and pay has to be agreed upon by both parties, otherwise the mediation meeting will stop at the 2-hour scheduled time frame. Overtime fee payment is required at the end of mediation.

  • Any and all Cancellation and/or Rescheduling must be made at least seven (7) calendar days prior to the mediation scheduled date. 

  • Failure to provide seven (7) calendar days notice will forfeit the mediation fee.​

Overtime Fee | County Civil Mediation

BBM Overtime Commitment:

  • The mediator will notify each party as the 2-hour scheduled mediation timeframe approaches.

  • The parties can discuss with the mediator if overtime would be conductive to advancing and/or reaching agreements.

  • If the parties do not mutually agree to going overtime, the mediation will stop at the scheduled 2-hour timeframe.

  • If additional research and consideration is needed, the parties can choose to schedule a second 2-hour mediation; full mediation fees and terms apply.

Notice/ Overtime Fee Payment:

  • Payment of Overtime Fee applies to all mediation settings, whether in person, phone, or video and audio conference.

  • Mediation Overtime Fee (OT) are additional hours approved by the parties during mediation. Mediation. Overtime fees can be applied to any mediation task as needed.

 

  • Overtime Fee (OT) is charged at $50.00 per hour, per party. ​​Not reaching consensus for mediation overtime payment by both parties will stop the mediation at the scheduled 2-hour time frame. 

  • Indigent parties (IFP) with a State Approved Reduced Fee has a State Reduced Rate of $15.00 per hour, per party.​ No-Show Indigent parties may invalidate the reduced rate and apply full mediation fees.

  • Pursuant to applicable laws and regulations on protecting personal data and information. Beyond Borders Mediation (BBM) and it affiliates with registered trade names at the Colorado Secretary of State, do not request (unless for clearly stated purposes i.e.: "payment for services"), share, sell, nor disclose information unless it is required by law or statute.​- Click here for Information Privacy & BBM's Privacy Policy.

No - Show

  • Failure to appear to a scheduled mediation will cancel the mediation. A Fee covering the Full Mediation Cost $200.00, in addition to $100.00 rescheduling fee will be imposed on the No-Show party to be paid before the next court-ordered mediation.

​​Overtime​​

  • Additional mediation beyond the initial 2-hours and pay must be agreed upon by both parties not reaching consensus on overtime will end the mediation at the initial 2-hour scheduled time frame. 

  •  As the initial 2-hour time frame gets close, the mediator will notify the parties, and discuss if additional time is needed and  convenient.

  • Additional overtime may be applied to any mediation task as needed. Such as further negotiation, mediation time, agreement writing, memorandum of understanding (MOU), modifications, corrections, fine-tuning, and/or further agreements made within the editing and review of the MOU.

  • Overtime fee payment is required at the end of mediation.

Terms: Cancellation & Rescheduling

Cancellation & Rescheduling terms apply to all mediation settings, whether in person, phone, or video/audio conference.

Any and all Cancellation and/or Rescheduling must be made at least seven (7) calendar days prior to the mediation scheduled date. 

  • Failure to provide seven (7) calendar days notice will forfeit the mediation fee.

 

No - Show Cancellation

  • Failure to appear to a scheduled mediation will cancel the mediation. A Fee covering the Full Mediation Cost $200.00 will be imposed on the No-Show party to be paid before the next court-ordered mediation in addition to the $100.00 rescheduling fee.   

Cancellation Due To Non-Payment

  • Mediation Fees are due ten (10) calendar days before the date scheduled for mediation. Failure to comply with the required fee/dates by either party will result in a cancellation of mediation.​

  • Canceling penalties may be imposed.

  • Mediation may be rescheduled pending all parties' approval, and the mediators' schedule.

Late Cancellation by Either Party

  • Cancellations must be made seven (7) calendar days prior to the mediation scheduled date.

  • All parties are required to agree to the cancelation.

  • Failure to provide seven (7) calendar days' notice of cancellation will forfeit the mediation fee.

Late Cancellation per Both Parties Agreement

  • Cancellations must be made seven (7) calendar days prior to the mediation scheduled date.

  • All parties are required to agree to the cancelation.

  • Failure to provide seven (7) calendar days notice of cancellation will forfeit the mediation fee.

Cancellation Due To Agreement Reached Between the Parties

  • Cancellations must be made seven (7) calendar days prior to the mediation scheduled date.

  • All parties are required to agree to the cancelation.

  • The agreement reached between the parties has to be filed and registered with the court seven (7) calendar days before canceling mediation.

  • Failure to provide seven (7) calendar days notice of cancellation will forfeit the mediation fee.
